Firearms Law

Gun owners in California are faced with a nearly incomprehensible web of statutes, regulations, ordinances, and other laws that bear on all aspects of the ownership, possession, and discharge of firearms and ammunition. The complexity of the law virtually requires that gun owners become legal scholars in order to avoid violations when exercising their Constitutional right to keep and bear arms. In fact, law enforcement officers frequently misapply or are simply ignorant of the law as it pertains to the possession and transportation of firearms and ammunition. Even the California Department of Justice has misinterpreted the law to the detriment of gun owners by attempting to promulgate underground regulations in contravention of existing laws. For these reasons, many otherwise law-abiding citizens find themselves subject to prosecution based on alleged violations of the myriad cryptic laws regulating guns, ammunition, and other related items.

In addition to being an avid firearms enthusiast and collector, Mr. Richards has been politically active in the Second Amendment movement for more than a decade. He is continues to be involved in ongoing civil rights litigation to advance the rights of gun owners in California. Mr. Richards can bring to bear his firearms knowledge with his legal expertise to defend against any firearms-related offenses including, but not limited to:

  • Possession of assault weapons
  • Importation or manufacturing of high capacity magazines (a.k.a. high capacity clips)
  • Illegal transfers of firearms
  • Possession of destructive devices
  • Unlawful possession/carrying of a firearm
  • Unlawful possession/carrying of a concealed firearm
  • Being a prohibited person found in possession of a firearm or ammunition
  • Being a prohibited person found in possession of a firearm or ammunition
  • Possession of a firearm in a prohibited area
  • Brandishing a firearm
  • Discharge of a firearm in a grossly negligent manner or in an unauthorized area
  • Homemade firearms
  • Unserialized firearms

Mr. Richards can also facilitate the return of firearms seized by law enforcement, assist in applying for a CCW permit or in appealing a permit denial, and provide consultation concerning any firearms-related questions, including inquiries about how new laws will affect gun owners.
